Terms of Service

You must be at least 18 years old to use the Service. By using motionswap you represent and warrant that you are 18 or older, that you have the legal capacity to enter into these Terms, and that your use of the Service complies with all laws that apply to you. The Service is not directed to and may not be used by minors.

motionswap lets you place a face (a photo you upload or an AI-generated avatar) into a short video using artificial intelligence. Outputs are generated automatically by third-party AI models and are provided for your personal, lawful use. AI results may be imperfect, inaccurate, or not as expected, and we do not guarantee any particular outcome.

You are responsible for your account and for keeping your login secure. You must provide accurate information, you are responsible for all activity under your account, and you must notify us promptly of any unauthorised use. We may refuse, suspend, or terminate accounts at our discretion, including for violations of these Terms.

The Service may only be used for lawful, consensual content. You must have the rights and all necessary consents for every face, image, and video you upload or generate. You agree that you will NOT use motionswap to create, upload, or share content that:

• depicts a real, identifiable person without their explicit consent, including any non-consensual or deceptive "deepfake";
• is sexual or intimate in nature involving a real person, or that constitutes non-consensual intimate imagery ("deepfake pornography");
• depicts, sexualises, or endangers minors in any way — this is strictly prohibited and will be reported to the authorities;
• impersonates a real person, brand, or official, or is intended to deceive, defraud, scam, or spread misinformation (including political or election-related deception);
• harasses, bullies, threatens, defames, or harms any person, or that is hateful or discriminatory;
• infringes anyone's intellectual property, privacy, publicity, or other rights;
• is otherwise illegal where you or the depicted person are located, or that violates any third-party platform's rules where you share it.

You also agree not to misuse the Service technically — for example, by reverse-engineering it, scraping it, abusing or circumventing usage or credit limits, introducing malware, or reselling access without our permission.

You keep ownership of the photos and videos you upload and the results you generate ("Your Content"). You grant motionswap a limited, worldwide, non-exclusive licence to host, store, process, and transmit Your Content solely to operate and provide the Service to you (for example, sending it to our AI provider to produce a swap and storing the result in your account). You represent and warrant that you have all rights and consents necessary to grant this licence and to create the content you make.

The Service itself — including the motionswap name, logo, software, and design — is owned by us and protected by law. These Terms do not grant you any rights to our brand or software except the right to use the Service as permitted here.

The Service uses credits. One credit is consumed per face swap, at the moment the swap starts. Credits are obtained by purchasing a subscription plan or a one-off top-up pack; there is no free tier. Any promotional credits we may choose to grant have no cash value, are non-transferable, and may change or end at any time.

We offer four paid plans, billed monthly: Starter ($9.99/month, 3 swap credits), Pro ($29.99/month, 10 credits), Max ($79.99/month, 30 credits), and Ultra ($129.99/month, 50 credits). Prices are in US dollars. Each plan renews automatically every month and charges the same price until you cancel.Each successful monthly payment adds that plan's credits to your balance. We also sell one-off credit top-up packs (currently Top-up 3 at $14.99 and Top-up 10 at $44.99). Packs are single purchases: they do not renew, and their credits join the same balance.

AI avatar generation is unlimited, subject to fair use. Generating an avatar does not consume a credit. To keep the service available to everyone we apply a fair-use limit of 20 avatar generations per hour per account; it is set well above normal use and exists only to stop automated abuse. We may adjust it if we need to.

Credits are added to a single running balance. Unused credits roll over— they are not reset or removed at renewal, and they don't expire while your account exists. If you cancel, you keep any credits already granted and can still use them; cancelling only stops future charges and future credit grants.

motionswap is the supplier of the Service. Card payments are taken and settled by our payment provider, Whop(whop.com), which acts as merchant of record; any applicable taxes are shown at checkout. Your statement will show WHOP* MOTIONSWAP, and receipts come from no-reply@whop.com. Completing a purchase also creates a Whop account under the email you pay with, and the payment side of your purchase is additionally governed by Whop's Buyer Terms (whop.com/buyer-terms). By subscribing you authorise that payment method to be charged each month until you cancel.

If we change the price of your plan, we will give you advance notice before the new price applies to a renewal, and you can cancel before it takes effect.

You can cancel anytime.The quickest way is the "Manage subscription" card on your Account page, which cancels at the end of the paid period. You can also cancel in your Whop account: sign in at whop.com with the email you paid with, go to Profile → Orders, open your motionswap membership, and choose Cancel membership. Cancel before your renewal date to avoid the next charge. After cancelling, your plan stays active until the end of the paid month and you keep your credits.

Refunds are governed by our Refund Policy. In short: credits consumed to generate content are non-refundable because real processing costs are incurred; a credit is automatically returned if a generation fails on our side; and if you're an EU, EEA, or UK consumer you have a 14-day withdrawal right as described in that policy.

If a payment is refunded or charged back, the credits granted by that payment are removed from your balance. If you have a billing problem, email iammuneebrafi@gmail.com first.

We may review, remove, or disable content and suspend or terminate access that we believe violates these Terms, is non-consensual or deceptive, or creates a legal or safety risk — with or without notice. If you believe content on the Service infringes your rights or depicts you without consent, or to report any abuse, contact us at iammuneebrafi@gmail.com and we will act promptly. We cooperate with lawful requests from authorities.

The Service and all outputs are provided "as is" and "as available" without warranties of any kind, whether express or implied, including fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the Service will be uninterrupted, secure, or error-free, or that AI outputs will meet your expectations.

To the maximum extent permitted by law, motionswap and its operators will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising from your use of the Service or any content created with it. To the maximum extent permitted by law, our total liability for any claim relating to the Service will not exceed the amount you paid for the Service (through Whop or otherwise) in the three months before the claim.

You agree to indemnify and hold harmless motionswap and its operators from any claims, damages, liabilities, and costs (including reasonable legal fees) arising from your content, your use of the Service, or your violation of these Terms or of any law or third-party right.

You may stop using the Service at any time. We may suspend or terminate your access if you breach these Terms or to comply with the law. Sections that by their nature should survive termination (including content licences for already-processed content, disclaimers, limitations of liability, and indemnities) will survive.

These Terms are governed by the laws of the Islamic Republic of Pakistan, without regard to conflict-of-laws rules, and you agree to the non-exclusive jurisdiction of the courts located there, except where mandatory local consumer law gives you other rights. If you are a consumer in the EU, EEA, or UK, nothing in these Terms limits the mandatory consumer rights of the country you live in, including your withdrawal and refund rights.
